1. Introduction

Welcome to SKYLINE PLUS, a business operating under SKYLINE NETWORK, located at Shop No. 2, Omkar Darshan, Masoli, Opp. Westcost Hospital, Dahanu (W), Palghar, Maharashtra, Thane – 401602.

These Terms & Conditions (“Terms”) govern your access to and use of our website, digital communication services, WhatsApp Official Business API communications, Rich Communication Services (RCS) messaging, and related services (collectively referred to as the “Services”).

By accessing, registering for, or using any services offered by SKYLINE PLUS, you agree to be legally bound by these Terms in accordance with the applicable laws of India. If you do not agree with these Terms, you must discontinue use of our Services immediately.


2. Definitions

For the purpose of these Terms:

  • “Company,” “We,” “Us,” “Our” refers to SKYLINE PLUS.
  • “User,” “You,” “Customer” refers to any individual or entity accessing or using our Services.
  • “Services” means all services provided by SKYLINE PLUS including digital communication, WhatsApp Business messaging, RCS messaging, customer support messaging, and related offerings.
  • “WhatsApp Official API” refers to Meta’s approved WhatsApp Business Platform.
  • “RCS” refers to Rich Communication Services enabled via telecom operators or approved aggregators.
  • “Platform Providers” means Meta Platforms Inc., Google, telecom operators, messaging aggregators, or related technology partners.

3. Acceptance of Terms

By:

  • Registering for our Services,
  • Submitting your contact details,
  • Opting in to receive WhatsApp or RCS communications,
  • Using our website or interacting with our messaging channels,

you confirm that you have read, understood, and agreed to these Terms.

Continued use of the Services constitutes ongoing acceptance of the latest version of these Terms.


4. Description of Services

SKYLINE PLUS provides digital communication and customer engagement services, including but not limited to:

  • Business messaging through WhatsApp Official API
  • RCS-enabled communication
  • Customer notifications and transactional alerts
  • Promotional communications (where consent is obtained)
  • Customer service messaging
  • Digital account-related communications

All services are provided subject to compliance with Meta Business Messaging Policies, Google RCS policies, telecom regulations, and applicable Indian laws.


5. Eligibility

You must:

  • Be at least 18 years of age;
  • Be legally competent to enter into binding contracts under the Indian Contract Act, 1872;
  • Provide accurate and complete information;
  • Not be prohibited under Indian law from using digital communication services.

SKYLINE PLUS reserves the right to refuse service if eligibility requirements are not met.


6. Account Registration

Certain Services may require registration.

You agree to:

  • Provide accurate information;
  • Maintain confidentiality of login credentials;
  • Notify us immediately of unauthorized access;
  • Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts found to contain false, misleading, or incomplete information.


7. User Responsibilities

By using our Services, you agree:

  • Not to misuse messaging platforms;
  • Not to send unlawful, abusive, fraudulent, or misleading content;
  • Not to attempt unauthorized system access;
  • To comply with applicable laws including the Information Technology Act, 2000;
  • To comply with Meta and Google messaging guidelines.

Users are strictly prohibited from sending spam, phishing content, financial scams, or misleading advertisements through our communication channels.


8. Payment & Billing Terms

Where applicable:

  • Fees shall be communicated prior to service activation.
  • All payments must be made in Indian Rupees (INR).
  • Taxes, including GST (if applicable), shall be borne by the user.
  • Delayed payments may result in suspension of services.

SKYLINE PLUS reserves the right to modify pricing upon reasonable notice.


9. Subscription Renewal & Termination

Subscriptions, if applicable:

We may suspend or terminate Services:

  • For violation of these Terms,
  • For breach of Meta or RCS policies,
  • For non-payment,
  • For legal or regulatory requirements.

Termination does not waive outstanding payment obligations.


10. Use of WhatsApp Official API & RCS

SKYLINE PLUS uses approved WhatsApp Business API and RCS platforms.

Users acknowledge that:

  • WhatsApp and RCS messaging is subject to third-party platform availability;
  • Message delivery is not guaranteed;
  • Messaging must comply with opt-in requirements;
  • Template messaging may require pre-approval from Meta.

We strictly follow:

  • Meta Business Messaging Policy,
  • WhatsApp Commerce Policy,
  • Google RCS Business Messaging guidelines.

11. Message Delivery & Compliance Policy

Users consent to receive:

  • Transactional updates;
  • Service notifications;
  • Account-related alerts;
  • Promotional messages (only with explicit opt-in).

We maintain:

  • Opt-in records,
  • Opt-out mechanisms,
  • Compliance logs.

Users may opt-out anytime by replying “STOP” or contacting us directly.


12. Intellectual Property Rights

All content including:

  • Logos,
  • Brand name SKYLINE PLUS,
  • Website materials,
  • Messaging templates,
  • Design elements,

are the intellectual property of SKYLINE PLUS and protected under Indian copyright and trademark laws.

Unauthorized reproduction is strictly prohibited.


13. Confidentiality

Both parties agree to maintain confidentiality of:

  • Business information,
  • Customer data,
  • Proprietary systems,
  • Communication logs.

Confidential information shall not be disclosed except as required by law.


14. Disclaimer of Warranties

Services are provided on an “as-is” and “as-available” basis.

We do not guarantee:

  • Uninterrupted service,
  • Error-free messaging,
  • Platform uptime,
  • Third-party network availability.

SKYLINE PLUS disclaims all implied warranties including merchantability and fitness for a particular purpose.


15. Limitation of Liability

To the maximum extent permitted under Indian law:

SKYLINE PLUS shall not be liable for:

  • Indirect damages,
  • Loss of profits,
  • Business interruption,
  • Data loss,
  • Messaging delays caused by third-party platforms.

Total liability shall not exceed the amount paid by the User in the preceding three (3) months.


16. Indemnification

You agree to indemnify and hold harmless SKYLINE PLUS from claims, damages, liabilities, penalties, and legal costs arising out of:

  • Misuse of messaging platforms;
  • Violation of laws;
  • Breach of these Terms;
  • Non-compliance with Meta or telecom policies.

17. Governing Law (India)

These Terms are governed by the laws of India.

Jurisdiction shall lie exclusively with courts located in Palghar District, Maharashtra.


18. Changes to Terms

We reserve the right to modify these Terms at any time.

Updated versions will be published on our website with revised effective dates.

Continued use after updates constitutes acceptance.
